When the European Union's Artificial Intelligence Act entered into full enforcement for high-risk AI systems in August 2025, most commentary focused on European enterprises and large US technology companies. Largely overlooked in that coverage: the thousands of Latin American organizations with EU market exposure, EU data subjects, or technology supply chain relationships with EU-regulated entities who now face real compliance obligations — many of whom are significantly underprepared.
This guide is intended for legal, technology, and compliance leaders at Latin American enterprises navigating EU AI Act requirements. It is not an exhaustive legal analysis — that should come from qualified counsel in your specific jurisdictions. It is a practical framework for understanding your exposure, assessing your current state, and building a credible compliance roadmap.
Understanding Your EU AI Act Exposure
The EU AI Act applies based on where AI systems are deployed and whose interests they affect — not where the organization deploying them is headquartered. A Colombian bank using AI to make credit decisions about EU citizens has EU AI Act obligations. A Brazilian technology company supplying AI-powered software to European enterprise customers has obligations under the Act. A Mexican e-commerce platform using AI-driven pricing for European consumers has obligations.
The extraterritorial reach of EU AI Act is analogous to GDPR — and Latin American enterprises should approach their AI Act compliance planning with that precedent in mind. GDPR compliance programs built by leading Latin American organizations in 2018–2020 are valuable foundations for EU AI Act compliance, particularly in the areas of data governance, privacy impact assessment, and regulatory documentation practices.
The Risk Classification Framework
The EU AI Act classifies AI systems into four risk tiers, each with distinct compliance requirements:
Unacceptable Risk (Prohibited): AI systems that pose unacceptable risks to fundamental rights are prohibited outright. These include social scoring systems by public authorities, manipulation of individuals through subliminal techniques, real-time biometric identification in public spaces (with narrow exceptions), and AI systems that exploit vulnerabilities of specific groups. For most Latin American enterprises, prohibited systems are not a direct concern — but reviewing your AI portfolio against this category is an essential first step.
High Risk: This is where most compliance obligation lies for Latin American enterprises with EU exposure. High-risk AI systems include those used in critical infrastructure, education and vocational training, employment and worker management, access to essential services (including credit), law enforcement, migration management, and administration of justice. If your organization uses AI in any of these domains in connection with EU market participants, you have high-risk compliance obligations.
High-risk obligations include: conformity assessment before deployment, registration in the EU AI database, technical documentation requirements, transparency and explainability requirements, human oversight mechanisms, accuracy and robustness requirements, data governance requirements, and ongoing monitoring and incident reporting.
Limited Risk: AI systems in this category — primarily chatbots, AI-generated content, and emotion recognition systems — face transparency obligations: users must be informed they are interacting with AI, and AI-generated content must be labeled as such. These requirements are already in force and broadly applicable.
Minimal Risk: AI systems posing minimal risk ��� spam filters, AI-assisted manufacturing quality control, AI-powered recommendation systems in non-sensitive contexts — face no mandatory obligations under the Act, though voluntary adherence to codes of practice is encouraged.
Enforcement Timeline and Current Status
The EU AI Act's enforcement is phased. Prohibited AI practices have been banned since February 2025. Transparency obligations for limited-risk systems have been in force since August 2025. High-risk system requirements for systems covered by existing EU product legislation (medical devices, machinery, vehicles) apply from August 2026. High-risk systems in other categories face requirements from August 2027.
Critically, the Act's obligations for general-purpose AI models — foundation models like GPT-5, Gemini, and Claude that underpin many enterprise AI applications — have been in force since August 2025. If your organization deploys general-purpose AI models that could pose systemic risks, or if you are a provider of such models serving EU markets, these obligations are live.
"Latin American enterprises that are waiting for 2027 to begin their EU AI Act compliance programs are making a strategic error," says Ramírez. "Compliance programs of this scope take 12 to 24 months to build properly. If you start in 2026, you will be in compliance firefighting mode in 2027. If you start now, you can build a program that actually works and that positions you advantageously in EU markets."
The Practical Compliance Roadmap
Step 1: AI Inventory and Classification (Months 1–2). Catalog every AI system in use across your organization. For each system, assess whether it has EU market exposure — does it process EU citizen data, make decisions affecting EU individuals, or operate in EU regulated markets? For exposed systems, apply the EU AI Act risk classification framework. This inventory is the foundation of your compliance program.
Step 2: Gap Analysis Against High-Risk Requirements (Months 2–4). For each AI system classified as high-risk, conduct a structured gap analysis against EU AI Act requirements. The gap analysis should cover: technical documentation completeness, conformity assessment readiness, data governance adequacy, human oversight mechanisms, transparency and explainability capabilities, incident monitoring and reporting procedures, and registration requirements.
Step 3: Governance Structure and Ownership (Months 3–5). Establish the organizational governance structure for EU AI Act compliance. This requires: a named Responsible AI Officer (or equivalent) with executive authority, clear ownership of each high-risk AI system, a cross-functional AI governance committee, and integration of AI compliance into existing risk management, legal, and audit functions.
Step 4: Remediation and Control Implementation (Months 4–12). Implement the controls, documentation, and processes needed to close gaps identified in Step 2. Prioritize by risk level and enforcement timeline. For systems facing August 2026 deadlines, remediation must be complete by Q1 2026 to allow adequate testing and validation.
Step 5: Conformity Assessment and Registration (Months 10–14). Complete conformity assessments for high-risk systems as required. Register applicable systems in the EU AI database. Engage qualified EU legal counsel to review compliance documentation and represent your organization in any regulatory interactions.
The ISO 42001 Connection
One of the most important practical insights for Latin American enterprises navigating EU AI Act compliance is the substantial overlap between ISO 42001 and EU AI Act requirements. A mature ISO 42001 program addresses a significant proportion of EU AI Act governance requirements — risk assessment methodology, documentation practices, incident management, human oversight mechanisms, and the organizational governance structures the Act requires.
For organizations facing both ISO 42001 and EU AI Act compliance requirements, pursuing an integrated compliance program — using ISO 42001 as the governance framework and mapping EU AI Act requirements onto it — is both more efficient and more effective than treating them as separate workstreams. The ISO 42001 certification process also produces documented evidence of governance maturity that is valuable in any regulatory interaction.
The Competitive Dimension
EU AI Act compliance is not only a risk management requirement — it is, for Latin American enterprises competing in European markets, a commercial necessity. EU enterprise procurement increasingly includes AI compliance requirements in vendor assessments. EU financial services regulators are beginning to require AI compliance evidence from service providers. EU consumers are increasingly aware of AI Act protections and are making choices accordingly.
Latin American organizations that build genuine EU AI Act compliance capabilities — not superficial paper programs but operational governance that actually changes how AI systems are built and deployed — will be positioned to grow their EU market presence as less-prepared competitors face enforcement action and reputational consequences. The compliance burden is real, but so is the competitive opportunity for organizations that rise to meet it.
